These Terms and Conditions apply to purchases by the Customer on bblux.co.uk. By ordering Goods you agree to be bound by them.
The Supplier is U-Consulting Ltd (trading as BBLux Jewelry & Accessories), registered in England and Wales under number 10717944. Registered office: 8 Martindown Road, Whitstable, Kent, CT5 4PX. Trading address: 166 High Street, Herne Bay, Kent, CT6 5AJ. Contact: info@bblux.co.uk; 01227 749626. By placing an Order you must click "I Accept" to complete your purchase. You must be at least 18 years old and eligible to enter into a contract.
Consumer means an individual acting wholly or mainly outside trade, business, craft or profession. Contract means the legally-binding agreement between you and the Supplier for the supply of Goods. Delivery Location means where the Goods are to be supplied as set out in the Order. Durable Medium means paper, email, or any medium allowing personal address, storage for future reference and unchanged reproduction. Goods means the items advertised on the Website as described in the Order. Order means the Customer's order following the Website's step-by-step process. Privacy Policy means the terms setting out how confidential and personal information is handled. Website means www.bblux.co.uk where the Goods are advertised.
Goods descriptions appear on the Website, catalogues or brochures for illustrative purposes only — small discrepancies in size and colour may occur. For Goods made to your specifications, you must ensure the accuracy of the information you provide. All Goods are subject to availability. Changes necessary for legal or safety compliance will be notified to you.
All information is retained and used strictly under the Privacy Policy. You expressly agree to be contacted via email, electronic communication or pre-paid post.
Website descriptions do not constitute a contractual offer. Orders can be rejected for any reason. Each ordering step allows you to check and amend errors and you are responsible for the correct use of the process. A Contract is formed only when you receive an Order Confirmation email — you must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. Quotations are valid for a maximum of 7 days from date unless earlier withdrawn. No Contract variation is permitted after formation unless agreed in writing by both parties. These Terms apply only to Contracts with Consumers; non-consumers must notify the Supplier for alternative terms.
Price includes additional charges as set out on the Website or otherwise agreed in writing. Prices and charges include VAT at the applicable rate at the time of Order. Payment is by credit or debit card details submitted with the Order; payment may be taken immediately or before delivery.
Goods will be delivered within the agreed period or without undue delay, and not exceeding 30 days after Contract formation. If delivery is not on time you may treat the Contract as ended where: the Supplier refuses delivery; delivery on time was essential per Contract terms; or after late delivery you specified a later period and the Supplier failed to meet it. If the Contract is ended, the Supplier will promptly return all payments made. Goods may be delivered in instalments for stock shortages or genuine reasons, with no extra charges. Commercial units cannot be partially cancelled or rejected.
Risk of damage or loss passes to you when the Goods are delivered. You do not own the Goods until we have received payment in full. If payment is overdue or bankruptcy proceedings commence, the Supplier may cancel delivery and end usage rights.
You may withdraw the Order before Contract formation without reason or liability. You may cancel the Contract (except Goods made to special requirements) within 7 calendar days from Contract formation without reason or liability — you must return the Goods in undamaged condition at your own expense to any of our business premises. The Supplier refunds the price but may retain separate delivery charges. This Returns Right differs from the Cancellation Rights below. Cancellation Rights do not apply to Goods made to your specifications or personalised, Goods liable to deteriorate or expire rapidly, and cease if Goods become inseparably mixed with other items after delivery.
Subject to these Terms you may cancel within 7 days without reason. The cancellation period expires 7 days from when you (or a non-carrier third party) acquire physical possession of the last Goods. For subscriptions, cancellation rights run for 7 days after first delivery. To cancel, inform the Supplier via clear statement (letter, fax, email). You can also electronically fill in and submit the model cancellation form or any other clear statement of your decision to cancel the Contract on our website. To meet the cancellation deadline the communication must be sent before the period expires.
Upon cancellation the Supplier reimburses all payments including delivery costs, except supplementary costs for non-standard delivery options. The Supplier may deduct from the reimbursement any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
If the Supplier does not offer collection, reimbursement occurs without undue delay and not later than 14 days after we receive the returned Goods (or, if earlier, 14 days after you provide evidence of dispatch). Reimbursement uses the same payment method as the initial transaction unless otherwise agreed; no fees apply to reimbursement. If no Goods were supplied, the Supplier provides a voucher of equivalent value within 14 days of informed cancellation.
Cancelled Goods must be returned to 166 High Street, Herne Bay, Kent, CT6 5AJ within 14 days from cancellation communication without delay. You agree that you will have to bear the cost of returning the Goods.
The Supplier has a legal duty to supply Goods in conformity with the Contract. Upon delivery, Goods must be of satisfactory quality, reasonably fit for any particular purpose disclosed before Contract formation, and conform to description. Non-conformity does not apply if the failure originates in your materials. We will, immediately or within a reasonable time, give you the benefit of any free guarantee given by the manufacturer of the Goods — this does not reduce your statutory rights.
Either party may transfer Contract benefits to another, while remaining liable for obligations. The Supplier is liable for chosen sub-contractors' acts.
Upon failure due to circumstances beyond reasonable control, the failing party advises the other as soon as reasonably practicable; obligations are suspended as is reasonable, provided the party acts reasonably and avoids preventable failures. This does not affect the delivery rights or cancellation rights set out above.
Privacy is critical. The Supplier respects privacy and complies with the General Data Protection Regulation regarding personal information. These Terms should be read together with our Privacy Policy and Cookie Policy. The Supplier is a Data Controller of Personal Data processed in providing Goods. Where you supply Personal Data for Goods provision, the Supplier complies with Data Protection Laws by identifying collection purposes, processing only for identified purposes, respecting your Personal Data rights, and implementing appropriate technical and organisational security measures. The Supplier does not exclude liability for fraudulent acts or omissions, nor for death or personal injury arising from negligence or breach of legal obligations. Subject to this, the Supplier is not liable for losses not reasonably foreseeable at Contract formation, or for business losses (not suffered by Consumers) where the Supplier reasonably believes you are not buying wholly or mainly for business purposes.
The Contract is governed by the law of England and Wales. Disputes may be submitted to the courts of England and Wales, or — if you are in Scotland or Northern Ireland — to those respective courts. For disputes, please contact the Supplier first; we will aim to respond with an appropriate solution within 5 days.
